Family Class Sponsorship

Overview

Family Class Sponsorship lets Canadian Permanent Residents and Citizens sponsor family members. They must be 18 and able to support their family in Canada to achieve this.

Processing goals

The family class immigration programme reunites Canadians and permanent residents with their families. Through this sponsorship, the sponsor agrees to provide their family's basic necessities for a set time so they don't need social help.

We prioritise applications from spouses, common-law partners, and dependent children. Orphans, adopted children, and children to be adopted are prioritised since they are minors without parental care.

Roles and responsibilities of a sponsor

Sponsors must study the application guidance for the principal applicant's permanent residency category to accurately fill out the application and pay the payments. The application fee must include sponsorship and processing fees for the principal applicant and any dependents. As required for permanent residence, the Right of Permanent Residence Fee (RPRF) can be paid beforehand or subsequently. No RPRF payment is required for dependent children.

What is a sponsorship undertaking?

Sponsors and the IRCC Minister must sign the undertaking. Sponsors must sign an IMM 1344 to fund applicants who cannot support themselves.

Two types of sponsorship undertakings exist: federal ones submitted to the IRCC by sponsors outside Quebec, and provincial ones submitted to the Quebec Ministry of Diversity and Inclusion by sponsors in Quebec..

Spouse or Common Law Partner

Spouse or common law partner

Sponsoring a spouse or common-law partner and their dependant children in Canada or abroad is possible. They must be 18 and a Canadian citizen or permanent resident.

Canadian citizens or permanent residents who are in a romantic relationship with a foreign national can sponsor their partner for permanent status. Spouses, common-law partners, and conjugal partners can sponsor. Sponsorship has two main options: Outland and Inland sponsorship.

Criteria to become a sponsor

(1) Age 18 or older

(2) Be a Canadian citizen or permanent resident.

(3) If the sponsor is a Canadian citizen residing abroad, they must demonstrate their intention to move to Canada once the relative becomes a permanent resident.

(4) Permanent residents outside Canada cannot be sponsored.

(5) Show that they are not receiving government aid for non-disability causes.

(6) Support themselves, their partner, and their dependent children financially.

Sponsors living in Quebec

The province of Quebec regulates immigration.

(1) Sponsors in Quebec must apply first.

(2) Sponsors will get email or letter instructions to download Quebec's sponsorship package if they meet federal sponsorship standards.

(3) The Quebec undertaking kit must be submitted. The Quebec government undertaking application must include a copy of the email or letter.

The Quebec government will evaluate the sponsorship application and notify the candidate of eligibility.

Working – spouses and common-law partners in Canada

A spouse or common-law partner with a valid work or study permit can work or study. During permanent residency application, a spouse or common law partner can apply for an open work permit.

What are Outland and Inland sponsorship in Canada?

Inland Sponsorship

When living together in Canada, Canadian citizens and permanent residents can sponsor their spouse or common-law partner for permanent residence status through inland sponsorship.

Outland Sponsorship

The Canadian spouse or partner of a foreign national living outside Canada can sponsor them for permanent residence (PR) status.

How does Inland sponsorship work?

The visa office requires eligibility verification, supporting documents, and forms. The Canadian citizen or permanent resident must apply to sponsor, and the foreign spouse must apply for permanent residence.

How does Outland sponsorship work?

The process resembles inland sponsorship. Application and instructions are on the government website. If the candidate wants to settle in Quebec, they must obey its immigration laws.

Where are Inland applications processed?

Whether inland or outland sponsorship is chosen, the candidate must utilise a Canadian mailing address to submit their spousal sponsorship application. This is on the IRCC website.

How long does it take to process Outland applications?

IRCC takes 12 months to process spousal sponsorships.

Child Or Other Dependent

Overview

Candidates for permanent residency, work, study, or visit in Canada may be permitted to include dependant children. Children under 22 without a spouse or partner are dependent.

Family-class children receive Canadian permanent status and can study and work in Canada.

Am I Eligible to Sponsor my Child?

(1) Reach 18 or older.

(2) Have Canadian citizenship, permanent residency with the aim to return, or Indian Act registration.

(3) Ability to meet your own and your dependant children's and spouse's needs

(4) Show your parental relationship to your youngster.

(5) No criminal record.

(6) Not be imprisoned, bankrupt, or facing significant criminal charges.

(7) Respect past sponsorship agreements.

(8) Not be under immigration inquiry.

(9) No need for income aid until disabled.

Does my Child Qualify for Sponsorship?

To qualify,

(3) Born to the applicant or through aided human reproduction

(4) If the child was born to the parent's spouse or partner, it was not linked to the parent making the application.

Is the Process of Sponsoring a Child Different in Quebec?

Quebec's child sponsorship process is distinct. A few extra steps are needed beyond IRCC requirements. A provincial family law application must be filed with MIFI after a federal filing with IRCC. Candidates must then apply for the Quebec Selection Certificate.

In Quebec, the project is different. This agreement requires the candidate to sponsor the child for a set time and provide their basic needs.

How does the process of sponsoring a child for immigration work? Here are the four main steps involv

(1) Get an application packet from the government website. This bundle includes a detailed tutorial and forms for accurate completion.

What is the Super Visa for Parents and Grandparents?
